So long as all the skins are part of the FAF core files, everyone would see the other players chosen skin. Better yet it's 100% possible to make this a selectable lobby option.

by skins do you mean just different colors or unit shape change?

if it was different colors it should be a mod (probably like the way the advanced strategic icons mod is).

i like sako's idea of getting a custom acu skin as a reward (for say winning a tourney). I wonder if it could have a custom strategic icon as well.

this could also be a part of GW to indicate rank

I think this was based on my idea to try to gain a bit revenue for tournements etc. by selling skins, like LoL or other games do. (And maybe to hand out skins in very rare circumstances as prices or other events)

But the legal side of it always were a big issue..

It might be legal. Or not. And if it's not, the owner most likely won't care. But there is still some risk left.
