The use of copyrighted material, such as small community and non-profit nature, probably does matter under fair use clauses and other restrictions on IP, otherwise people would get sued for making the mods I've listed above (again, basic Google search, didn't follow links). Full disclosure: I have no experience with copyright law or gaming mods, just applying common sense to the lack of precedents for someone getting sued for the multiple mods out there.
Kind of a moot point via no one has the time or energy to do this.
It's not because they don't sue mod X that they cannot sue mod Y. However them suing mod X or Y relies on the fact that they are aware of the infringement. Of course they can decide not to pursue legal action even if they are aware. This means of course that an FAF mod is unlikely to be sued however creating it is still a copyright infringement. There's plenty of mods based on popular IP by various companies that have been shut down. I can't recall any specific examples of mods being shut down at the top of my head however EA for example is notorious for sending out Cease and Desist letters to modders using their IP.
Of course the details depend on the country who's copyright law you'd fall under or if there are any international agreements between the state of infringement and the state where the copyright exists.Statistics: Posted by Legion Darrath — 23 Sep 2014, 17:52
